3. Use of Services

3.1 Limited License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, and revocable license to access and use our Services for personal and non-commercial purposes, unless specifically authorized otherwise.

3.2 Use Restrictions

You are solely responsible for all User Content that you submit and the consequences of sharing it. You represent and warrant that:

  • You own or have the necessary licenses, rights, consents, and permissions to use and authorize Hire Services to use all User Content as contemplated in these Terms.
  • The User Content does not violate third-party rights, including, but not limited to, intellectual property rights and privacy rights.
  • All information provided is true, accurate, and complete.

4.3 Job Posting Content

Employers are responsible for the accuracy and legality of their job postings. Posted jobs must:

  • Represent real and current job opportunities.
  • Include accurate descriptions of functions, responsibilities, and requirements.
  • Not contain discriminatory requirements based on race, color, religion, sex, sexual orientation, gender identity, national origin, disability, age, or other characteristics protected by law.
  • Comply with all applicable labor laws.

We reserve the right to remove or reject any posting that violates these requirements or that we deem inappropriate for any reason.

4.4 Hire Services Content

Hire Services and its licensors own all rights, title, and interest in content created by Hire Services, including, but not limited to, text, graphics, interfaces, visual elements, design, compilation, software, codes, and materials (collectively, "Hire Services Content").

Hire Services Content is protected by copyright, trademarks, patents, and other intellectual property rights and laws. You may not modify, reproduce, distribute, create derivative works, publicly display, or commercially exploit any Hire Services Content, except as expressly permitted by us.

5. Premium Services and Payments

5.1 Paid Services

Some of our Services may require payment ("Premium Services"). The prices, availability, and other terms of purchase for Premium Services will be presented to you before purchase.

5.2 Payments and Billing

When purchasing Premium Services:

  • You agree to pay all applicable amounts, including taxes and processing fees.
  • You authorize Hire Services to charge your designated payment method.

  • For recurring subscriptions, you authorize automatic charges until cancellation.

5.3 Cancellations and Refunds

If you provide feedback, suggestions, or recommendations about the Services ("Feedback"), you grant Hire Services a perpetual, irrevocable, worldwide, royalty-free, and sublicensable license to use, reproduce, distribute, modify, create derivative works, publicly perform, and publicly display such Feedback without any attribution or compensation to you.

7.3 Trademarks

The name "Hire Services," the Hire Services logo, and other Hire Services names, logos, icons, and marks that identify our products and services are registered trademarks of Hire Services. Nothing contained in these Terms should be construed as granting any license or right to use any trademark without the prior written permission of Hire Services.

8. Disclaimers and Limitations

8.1 Warranty Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HIRE SERVICES DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

HIRE SERVICES DOES NOT WARRANT THAT (A) THE SERVICES WILL MEET YOUR REQUIREMENTS, (B) THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, (C) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICES WILL BE ACCURATE OR RELIABLE, OR (D) THE QUALITY OF ANY PRODUCT, SERVICE, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED THROUGH THE SERVICES WILL MEET YOUR EXPECTATIONS.

8.2 Responsibility for Third-Party Content

Hire Services is not responsible for content provided by third parties, including, but not limited to, job postings, company profiles, and communications between users. Hire Services does not endorse or is responsible for the accuracy, reliability, completeness, or legality of such content.

8.3 Relationships Between Job Seekers and Employers

Hire Services functions solely as an intermediary between job seekers and employers. We are not a party to any agreement between job seekers and employers, nor do we guarantee job offers, applications, or any outcome derived from the use of our Services. We are not an employment or recruitment agency, nor do we conduct background checks on employers or job seekers.

8.4 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HIRE SERVICES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS OR USE OR INABILITY TO ACCESS OR USE THE SERVICES, (B) ANY CONDUCT OR CONTENT OF THIRD PARTIES ON THE SERVICES, INCLUDING, WITHOUT LIMITATION, ANY DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF OTHER USERS OR THIRD PARTIES, (C) ANY CONTENT OBTAINED FROM THE SERVICES, OR (D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

IN NO EVENT WILL THE TOTAL LIABILITY OF HIRE SERVICES TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR THE SERVICES DURING THE TWELVE (12) MONTHS PRIOR TO THE CAUSE OF ACTION.

9. Indemnification

You agree to defend, indemnify, and hold harmless Hire Services, its directors, employees, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) resulting from or related to your violation of these Terms or your use of the Services, including, but not limited to, any use of Hire Services Content, Services, or information obtained from the Services, or your User Content.

10. Term and Termination

These Terms remain in effect until terminated by you or by Hire Services. You may terminate your agreement with us at any time by ceasing to use the Services and deleting your account.

Hire Services may terminate or suspend your access to all or part of the Services immediately, without prior notice or liability, for any reason, including, but not limited to, violation of these Terms. After termination, your right to use the Services will cease immediately.

All provisions of these Terms which, by their nature, should survive termination, will survive, including, without limitation, ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

11. Changes to Terms

We reserve the right to modify or replace these Terms at any time, at our discretion. If a revision is material, we will try to provide at least 30 days' notice before any new terms take effect. What constitutes a material change will be determined at our discretion.

By continuing to access or use our Services after revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Services.

12. General Provisions

12.1 Applicable Law

These Terms will be governed and interpreted in accordance with the laws of the United States, without giving effect to any principles of conflicts of law.

12.2 Dispute Resolution

Any dispute arising from or related to these Terms or the use of the Services will be resolved through friendly negotiation. If the dispute cannot be resolved through negotiation, it will be submitted to the exclusive jurisdiction of the courts of New York, United States.

These Terms constitute the entire agreement between you and Hire Services regarding the subject matter herein and supersede all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between you and Hire Services with respect to the Services.

12.4 Waiver and Severability

The failure of Hire Services to enforce any right or provision of these Terms will not constitute a waiver of that right or provision. If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the parties agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of the Terms remain in full force and effect.

12.5 Assignment

You may not assign or transfer these Terms, by operation of law or otherwise, without the prior written consent of Hire Services. Any attempt to assign these Terms without such consent will be void. Hire Services may assign or transfer these Terms, at its sole discretion, without restriction.

12.6 Notices

We may provide notices to you by email, posting on the website, or other reasonable means. You agree that such notices constitute adequate notification.
